Signed on May 4, 2020, Law No. 321-VI, On Amendments into Certain Labour-Related Legislative Acts of the Republic of Kazakhstan amended certain key provisions of the Labour Code.
Existing Night Work and Holiday Pay Provisions
Night Work Pay – According to Article 110 of the Labor Code, every hour of night work is paid an increased amount as per the terms of the applicable agreement. The premium rate for night work may not lower than 1.5 times the amount based on the daily/hourly rate of the employee.
Holiday Pay – According to Article 109 of the Labor Code, for working on a public holiday an employee is either given another day of rest or payment is made not lower than 1.5 times the amount based on the daily/ hourly rate of the employee.
Amendment to the Existing Rule
Effective May 16, 2020, if night work time coincides with a holiday or day off, payment must be made separately for the night hours and hours of holidays and days off.
